MT Extra Font License Agreement
(Preliminary, not for use)
Declarations
The MT Extra font was originally created by Design Science, Inc. (DSI), a
corporation with offices in Long Beach, California, USA; the MT Extra font and
works based on the MT Extra font are protected under U.S. and international
copyright law. The "Original Font" means the MT Extra font as
originally distributed by DSI. The "Font" means font data which
contains a notice placed by the copyright holder(s) saying it may be distributed
under the terms of this MT Extra Font License Agreement. The intent of this license (License) is to establish the freedom to share and
change the Font under the open source and free software models. This License
covers distribution of the Font (or modified versions of the Font) by itself or
included with proprietary, open source, or free software that uses the Font. This License covers all typeface technology (e.g.
PostScript and TrueType) variations and operating system (e.g. Microsoft
Windows, Apple Macintosh) variations of the Font.
License Grant
1. You are granted the non-exclusive rights set forth in this License provided you agree to and comply with any and all conditions in this
License. Whole or partial distribution of the Font in any form signifies acceptance of this
License.
2. You may copy and distribute the Font in unmodified form provided that you
distribute the entire package as received by you, including - but not restricted
to - copyright notices, trademark notices and disclaimers.
3. You may make modifications to the Font and distribute your modifications. The following restrictions apply to modifications:
a. Modifications must not alter or remove any copyright notices in
the Font.
b. If such modifications alter the order of glyphs (character images)
within the Font as compared to the order in the Original Font, add new glyphs
to the Font that are not included in the Original Font, or otherwise render
the Font incompatible with existing application programs and documents that
make use of the Original Font, then the modified Font must be given a name
other than "MT Extra". Such a renamed Font must adhere to all the
requirements of this License.
4. You may distribute the Font, or modified versions of the Font, provided
that you meet these restrictions:
a. You must include this License document in the distribution.
b. You must cause any modified version to also be released under this
License, with the modified version playing the role of the Font.
5. You may develop application programs, reusable components and other
software items that include the original or modified versions of the Font. If
such items are not available to the general public, we ask that you consider
supplying copies of the items to DSI, so that we can verify that the Font is
being used in a manner compatible with other applications also using the Font;
however this License does not require you to supply such items to DSI or to any
other party.
Use of Trademarks
This License does not grant any rights to use the
trademarks "MathType", "Design Science", or any other
trademarks owned by DSI, even if such marks are included in the Font.
Limitations of Liability
IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING
WILL DSI, ANY OTHER COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFY
AND/OR REDISTRIBUTE THE FONT AS PERMITTED ABOVE, BE LIABLE TO YOU FOR
DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL
DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE FONT (INCLUDING
BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR
LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE FONT TO
OPERATE WITH ANY OTHER FONTS OR PROGRAMS), EVEN IF DSI, SUCH HOLDER, OR
OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
No Warranty
The Font and this License document are provided AS IS with NO
WARRANTY OF ANY KIND, INCLUDING THE WARRANTY OF DESIGN, MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE.
Choice of Law
This License shall be governed by California law provisions (except to
the extent applicable law, if any, provides otherwise), excluding its
conflict-of-law provisions.
